1.1 เมื่อจองคิวแล้วกรุณาส่งบรีฟภายใน 7 วัน หลังจากวันที่ 7 เป็นต้นไปจะถือว่ายกเลิกการจองคิวนั้น ๆ และถือว่าเป็นการฝ่าฝืนข้อตกลงนี้
1.2 การยกเลิกคิวสามารถทำได้ทุกเมื่อภายใน 7 วันหลังการจองคิว หลังจากวันที่ 7 เป็นต้นไปจะถือว่าเป็นการฝ่าฝืนข้อตกลงนี้
1.3 ผู้รับจ้างมีสิทธิในการปฎิเสธการสร้างผลงานภายใน 7 วันหลังจากการส่งบรีฟ หลังจากวันที่ 7 เป็นต้นไปจะถือว่าเป็นการฝ่าฝืนข้อตกลงนี้2. ข้อตกลงเกี่ยวกับการสิทธิการใช้งานผลงานที่ได้ว่าจ้าง
2.1 ลิขสิทธิ์ของการสร้างสรรค์ผลงานเป็นของผู้รับจ้าง และลิขสิทธิในการใช้งานผลงานเป็นของผู้ว่าจ้าง
2.2 ห้ามวาดทับ ทำซ้ำ หรือดัดแปลงผลงาน
2.3 ห้ามแอบอ้างว่าผู้ว่าจ้างเป็นผู้สร้างสรรค์ผลงาน
2.4 ห้ามใช้งานผลงานในกิจกรรมที่มีความเกี่ยวข้องกับ AI, NFTs และ Cryptocurrency ทั้งสิ้นในทุกกรณี
2.5 การใช้งานเชิงพาณิชย์เป็นไปตามที่ได้ตกลงกันไว้เท่านั้น ซึ่งครอบคลุมการใช้งานดังนี้ : การนำผลงานไปใช้ในการขาย แถม หรือส่งเสริมการขาย รวมถึงการกระทำใด ๆ ที่ทำให้ได้รับรายได้ เช่น การใช้เป็นปกคลิป Youtube ที่เปิดรับรายได้/การโดเนท หากผู้รับจ้างและผู้ว่าจ้างตกลงเอาไว้ว่าเป็นผลงานที่ไม่สามารถใช้งานเชิงพาณิชย์ได้ จะไม่สามารถใช้งานในรูปแบบที่กล่าวมาข้างต้นได้3. ข้อตกลงเกี่ยวกับการเก็บผลงานเป็นความลับต่อสาธารณชน (NDAs)
3.1 ผู้รับจ้างจะเก็บผลงานเป็นความลับต่อสาธารณชนก็ต่อเมื่อผู้ว่าจ้างได้ทำการจ่ายค่าตอบแทนเพิ่มเติมอีกเป็น 50%-75% ของราคาเต็ม
3.2 การเก็บผลงานเป็นความลับต่อสาธารณชนหมายถึงการที่ผู้รับจ้างไม่เปิดเผยขั้นตอนการทำงานต่อสาธารณชนไม่ว่าจะเป็นที่ไหนก็ตามเป็นเวลา 30 วัน หรือหลังจากที่ผู้ว่าจ้างได้ทำการเปิดเผยต่อสาธารณชนแล้ว (สามารถตกลงเพิ่มเติมได้ใน DM) หลังจากเวลาที่กำหนด ผู้รับจ้างมีสิทธิเปิดเผยผลงานต่อสาธารณชนได้4. การจ่ายค่าตอบแทน
4.1 ผู้ว่าจ้างจะจ่ายค่าตอบแทนผ่านบัญชีธนาคารของผู้รับจ้าง, Paypal หรือ Tipme
4.2 การจ่ายค่าตอบแทนจะต้องจ่ายเป็นมัดจำอย่างน้อย 50% ของราคาเต็มก่อนเริ่มงาน และต้องจ่ายให้ครบราคาเต็มหลังเสร็จงาน5. การส่งผลงาน
5.1 ผู้รับจ้างจะส่งผลงานที่เสร็จสมบูรณ์แล้วผ่านจดหมายอิเล็กทรอนิคส์ (e-mail) และ Google Drive หลังจากที่ได้รับเงินค่าตอบแทนครบเต็มจำนวนแล้วเท่านั้น
5.2 การเก็บผลงานที่ผู้รับจ้างหลังจากการว่าจ้างเสร็จสิ้นแล้ว ซึ่งรวมถึงใน Google Drive ผู้รับจ้างจะสำรองงานเอาไว้ 30 วันเท่านั้น หลังจากนั้นจะไม่รับผิดชอบใด ๆ หากมีการเปลี่ยนแปลงหรือสูญหายของผลงานเกิดขึ้น6. การยกเลิกการว่าจ้างและขอคืนเงิน

6.2 ผู้รับจ้างจะคืนเงินเต็มจำนวนก็ต่อเมื่อผู้รับจ้างเป็นคนยกเลิกการว่าจ้างนั้น ๆ เอง หรือไม่สามารถทำงานได้ตามกำหนดเวลาที่ตกลงกันไว้เท่านั้น7. ข้อตกลงเมื่อฝ่าฝืนข้อตกลงนี้
7.1 การกระทำใด ๆ ที่ขัดต่อข้อตกลงที่กล่าวมาข้างต้นถือว่าเป็นการฝ่าฝืนข้อตกลงนี้
7.2 การฝ่าฝืนข้อตกลงนี้จะทำให้ผู้รับจ้างจะไม่รับงานใด ๆ จากผู้ว่าจ้างอีกในอนาคต และยึดสิทธิในการใช้งานผลงานนั้น ๆ ที่ได้กระทำการว่าจ้างไว้มาเป็นของผู้รับจ้างแต่เพียงผู้เดียว8. อื่น ๆ, การให้เครดิตในผลงานกับผู้รับจ้าง

Terms of Service for Commission WorkThe following terms constitute an agreement between Pitchi (hereinafter referred to as “the Artist”) and the client (hereinafter referred to as “the Client”). By agreeing to commission work or reserving a commission slot (hereinafter referred to as “reserving a slot”), the Client acknowledges and agrees to the terms outlined below.1. Agreement on Reserving a Slot
1.1 Upon reserving a slot, the Client must submit a detailed brief within seven (7) days. Failure to do so will result in the cancellation of the reservation, which will be considered a breach of this agreement.
1.2 The Client may cancel a reservation at any time within seven (7) days after booking. Cancellations after this period will be considered a breach of this agreement.
1.3 The Artist reserves the right to decline the commission within seven (7) days after receiving the brief. Any refusal after this period will be considered a breach of this agreement.2. Rights and Usage of Commissioned Work
2.1 The copyright of the commissioned work belongs to the Artist, while the usage rights are granted to the Client.
2.2 The Client is prohibited from reproducing, modifying, or tracing over the commissioned work without explicit permission.
2.3 The Client must not falsely claim to be the creator of the commissioned work.
2.4 The commissioned work may not be used in activities related to AI, NFTs, or cryptocurrency under any circumstances.
2.5 Commercial use of the commissioned work is only permitted as agreed upon. Commercial use includes but is not limited to selling, distributing, or using the work for promotional purposes or monetization, such as YouTube videos with monetization or donation incentives. If the work is agreed to be for non-commercial use, it must not be used in any of the aforementioned manners.3. Confidentiality Agreement (NDAs)
3.1 The Artist will keep the commissioned work confidential upon payment of an additional 50%-75% of the total price.
3.2 Confidentiality means the Artist will not publicly disclose the work or any progress for thirty (30) days or until the Client publicly reveals the work, whichever comes first. Extensions to this timeframe can be arranged via private communication. After the agreed period, the Artist reserves the right to showcase the work publicly.4. Payment Terms
4.1 Payments can be made via the Artist’s Bank account, PayPal, or TipMe.
4.2 All prices are quoted and payable in Thai Baht (THB).
4.3 A deposit of at least 50% of the total price is required before work begins. The remaining balance must be paid in full upon completion of the work.5. Delivery of Commissioned Work
5.1 The Artist will deliver the completed work via email and/or Google Drive only after receiving the full payment.
5.2 The Artist will retain a backup of the work for thirty (30) days following delivery. After this period, the Artist will not be responsible for any loss or changes to the work.6. Cancellation and Refund Policy
6.1 If the Client cancels the commission after the work has started, the deposit (50% of the total price) will be forfeited, and no part of the commissioned work will be delivered. Refunds will only apply to any amount paid beyond the deposit.
6.2 The Artist will provide a full refund only if the Artist cancels the commission or is unable to complete the work by the agreed deadline.7. Breach of Agreement
7.1 Any action that violates the terms outlined in this agreement constitutes a breach.
7.2 In the event of a breach, the Artist reserves the right to:
• Refuse any future commissions from the Client.
• Retain sole ownership and usage rights to the commissioned work.8. Credits and Acknowledgment
8.1 Whenever possible, the Client is requested to credit the Artist as Pitchi or @pitchi_e (Twitter) or via https://pitchicoms.carrd.co/.For any questions regarding these terms, please contact the Artist directly. If any term is violated, the Artist reserves the right to resolve the matter through discussion or take further action as outlined above.
